By submitting your order to The Digital Darkroom (IC Video Ltd), you represent and warrant to us that you either own the photographic content or have the written permission from the copyright owner to make such photographic content available for us to scan, store or use in any way required in providing our service.
You agree to indemnify, and hold The Digital Darkroom (IC Video Ltd) and its officers, directors, employees, affiliates, agents, licensors and business partners harmless, from and against any and all costs, damages, liabilities and expenses (including all legal fees and costs of defence) arising from a breach of your representations and warranties.
You agree not to use or attempt to use the Service with the following types of photographic content ("Prohibited Photographic Content"):
On occasion we may use customer images on our website and social media. We ensure we only use non personal images. Customers preferring us not to use any images must notify us by email.
The Digital Darkroom (IC Video ltd) is not liable for the photographic content, or any other materials, while in transit through or in possession of any third party (recommended or otherwise) carrier, including, but not limited to, the United Kingdom Royal Mail and UPS. You agree to accept complete liability for any photographic content, or any other materials, should they be misdirected, lost, stolen, or damaged while in the possession of, in transit
Limited Remedy for Loss of Original Photographic Content
The Digital Darkroom (IC Video Ltd) whilst we take every care of your original materials whilst in our possession we only assume the risk of loss of your original photographic content from the time that we actually receive the content to the time that we deliver the content to a third party carrier for transport. In the unlikely event of us causing damage to or loss of any of your material, we will compensate you up to the purchase value of the original media
If you have any reason to claim a refund please contact us by email. We will aim to refund you by the same method of payment as you paid if approriate.
